TRAXE provides a content verification and timestamping infrastructure service only. TRAXE does not verify the legal ownership, authorship, copyright status, or authenticity of any submitted content. A TRAXE Verification Record does not constitute legal proof of ownership or copyright and shall not be construed as such in any legal, regulatory, or commercial proceeding. TRAXE accepts no legal liability for claims arising from the use or misuse of its Verification Records.
01 About TRAXE
TRAXE (operated as TRAXE.co) is a content verification and registration platform providing cryptographic timestamping, hash fingerprinting, AI-assisted content origin detection, and origin declaration services for digital assets. TRAXE is designed to assist creators, studios, and organisations in documenting the declared origin and submission date of digital files.
TRAXE operates in support of transparency obligations under Regulation (EU) 2024/1689 on Artificial Intelligence (the "EU AI Act") and related regulatory frameworks. TRAXE is not, however, a legal authority, certification body, notary, accreditation agency, or regulatory organ. Participation in TRAXE does not constitute regulatory compliance.

02 Scope of Service
TRAXE provides the following services to registered users:
- Cryptographic SHA-256 fingerprinting of uploaded files
- Timestamping of submission date and time
- Recording of user-declared origin information (e.g. AI-generated, human-made, hybrid)
- Issuance of a unique TRAXE Verification ID (TRX-XXXXXXXX)
- A publicly accessible verification page linked to each registered submission
- AI content detection scanning via third-party image and video analysis APIs
- Dual AI engine analysis for image content (available on Pro plans and above), utilising two independent detection engines to produce a blended confidence score
- Single AI engine video detection (beta feature — see Section 06)
- A browser extension for scanning images on third-party websites
- Periodic automated content monitoring to detect potential unauthorised use of registered content (pre-launch — see Section 08)
TRAXE expressly does not:
- Verify the accuracy, truthfulness, or completeness of any information submitted by users
- Confirm copyright ownership or intellectual property rights in any submitted content
- Guarantee that submitted content is original, non-infringing, or lawfully owned by the submitting party
- Provide legal, regulatory, or compliance advice
- Act as a substitute for qualified legal counsel or official certification
- Guarantee the accuracy of AI detection results — all scores represent probabilistic estimates and not definitive findings
03 Accounts & Registration
To access TRAXE's paid features, content registration functionality, or AI scanning beyond the free tier allowance, you must create an account. By creating an account, you represent and warrant that:
- All registration information provided is accurate, current, and complete
- You are at least 18 years of age or have the legal capacity to enter binding agreements in your jurisdiction
- You will maintain the security and confidentiality of your account credentials
- You will notify TRAXE immediately at legal@traxe.co of any unauthorised use of your account
Each account is for individual or single-organisation use only. Creation of multiple accounts to circumvent plan limitations is prohibited and may result in permanent suspension of all associated accounts without refund.
04 Subscription Plans & Billing
TRAXE offers both free and paid subscription tiers. Paid subscriptions are billed on a monthly or annual basis via Stripe, Inc., TRAXE's third-party payment processor. All prices shown are inclusive of applicable VAT (21%). Business customers with a valid EU VAT number may qualify for VAT reverse charge at checkout.
- Starter (Free): 3 content registrations and 3 AI scans per month. No payment required.
- Creator (€11/month or €110/year incl. BTW): 30 registrations and 30 image scans per month.
- Pro (€35/month or €350/year incl. BTW): 100 registrations, 100 image scans per month, video scanning, and dual AI engine analysis.
- Studio (€96/month or €960/year incl. BTW): 300 registrations, 300 image scans per month, video scanning, dual AI engine, and branded verification page.
- Agency (€241/month or €2.410/year incl. BTW): 1,000 registrations, 500 image scans per month, video scanning, dual AI engine, and branded verification page.

Subscriptions renew automatically at the end of each billing period unless cancelled prior to renewal. Cancellation takes effect at the end of the current paid period. No partial refunds are issued for unused time within a billing period. TRAXE reserves the right to amend subscription pricing with no less than 30 days' prior written notice to registered users.
05 Scan Credit Packs
In addition to subscription allowances, TRAXE offers one-time scan credit packs. All prices are inclusive of applicable VAT (21%).
- Small Pack: 50 scan credits — €5 incl. BTW
- Medium Pack: 150 scan credits — €12 incl. BTW
- Large Pack: 500 scan credits — €35 incl. BTW
Credit packs apply to AI detection scans only and do not increase content registration limits. Credits are non-transferable, do not expire, and are tied to the purchasing account. Monthly subscription allowances are consumed first; credit pack deductions commence only upon exhaustion of the subscription allowance.
All credit pack purchases are final and non-refundable. If you believe a charge was made in error, contact legal@traxe.co within 14 calendar days of the transaction date.
06 AI Content Detection, Technical Scope & Limitations
6.1 General
TRAXE provides AI content detection via its web platform and browser extension. Detection results are generated by third-party machine learning APIs and represent probabilistic confidence estimates only — they are not definitive findings and should not be treated as such.
AI detection scores indicate the statistical likelihood that content was AI-generated. A score of 1% does not guarantee that content is human-made; a score of 99% does not guarantee it is AI-generated. Results may vary based on image resolution, compression, file format, content type, and the evolving capabilities of the underlying detection models.
TRAXE accepts no liability for editorial, legal, commercial, or regulatory decisions made on the basis of AI detection results.
6.2 Dual AI Engine (Pro Plans and Above)
Content registered under Pro, Studio, Agency, and Enterprise plans is analysed using two independent AI detection engines. The resulting confidence score represents a weighted average of both analyses. Individual engine scores are retained in the scan metadata and are available upon request for evidentiary or audit purposes. The use of dual engine analysis improves result reliability but does not eliminate the inherent probabilistic nature of AI detection.
6.3 Inconclusive Results
Where the two independent detection engines produce materially divergent confidence scores — defined as a difference of thirty (30) percentage points or greater — TRAXE will classify the result as "Scan Inconclusive." An Inconclusive result does not indicate system failure, content manipulation, or any finding of inauthenticity. It reflects the inherent limitation of probabilistic AI detection models when applied to content that contains both human-made and AI-assisted characteristics, or that exhibits visual properties that current detection models cannot reliably classify. Users and third parties shall not interpret an Inconclusive result as evidence of wrongdoing, misrepresentation, or non-compliance with applicable law. TRAXE accepts no liability for decisions, disputes, or claims arising from the characterisation of content as Inconclusive.
6.4 Video Detection (Beta)
Video content is analysed using a single AI engine. Video detection is provided as a beta feature and is subject to a higher rate of false positives and false negatives than image detection. TRAXE accepts no liability for decisions made based on video detection scores. Users are advised to treat video detection results as indicative only.
6.4 Supported File Formats
- Images: JPEG (.jpg / .jpeg) and PNG (.png)
- Video: MP4 (.mp4) and QuickTime (.mov)
HEIC, HEIF, WebP, and other proprietary or compressed formats are not currently supported. Files submitted in unsupported formats will not be scanned and may return a null detection result.
6.5 Metadata Capture & iOS Limitation
TRAXE captures EXIF metadata embedded in uploaded files, including device model, capture date, GPS coordinates, and software information, where available. This metadata is retained as part of the Verification Record.
Users uploading content from iOS devices (iPhone or iPad) via a mobile browser should be aware that Apple's Safari and Chrome for iOS browsers automatically strip EXIF metadata from image files prior to upload, pursuant to Apple's privacy framework. As a result, Verification Records created via iOS mobile browsers will not contain device or capture metadata. For full metadata capture, TRAXE recommends uploading from a desktop browser or an Android device.
07 Browser Extension
The TRAXE Scanner browser extension is provided free of charge for Chrome, Edge, and Brave. By installing the extension, you agree to these Terms of Service in full.
- The extension requires a valid TRAXE account to function
- Scans performed via the extension are deducted from your monthly allowance or credit balance
- The extension accesses images on third-party websites solely for AI detection and does not collect, store, or transmit any personal data from those websites
- TRAXE is not responsible for compatibility issues with specific websites, browser versions, or operating systems
- The extension is provided on an "as is" basis without warranty of any kind
08 Content Monitoring Service
TRAXE provides, or intends to provide as part of its Pro, Studio, Agency, and Enterprise plans, a periodic automated content monitoring service (the "Monitoring Service") that scans publicly accessible web pages and online platforms to detect potential unauthorised use of registered content.
- Monitoring is performed on a periodic basis (currently intended as weekly) and results are provided on a best-efforts basis only
- TRAXE does not guarantee that all instances of use will be detected. Content hosted on private networks, password-protected platforms, dark web environments, or platforms that restrict automated indexing will not be captured
- Match results generated by the Monitoring Service are indicative only. They do not constitute legal evidence of copyright infringement, misappropriation, or any other actionable wrong
- TRAXE accepts no liability for content that is missed, incorrectly matched, or not indexed by the Monitoring Service
- Users are solely responsible for evaluating monitoring results and for any legal, commercial, or regulatory action taken on the basis of those results
- TRAXE strongly recommends obtaining qualified legal advice before initiating any action based on monitoring results
09 User Declarations & Accuracy of Submissions
By creating a TRAXE account and submitting content, you declare, represent, and warrant that:
- All information submitted — including declared origin, tool used, creator identity, and file metadata — is accurate, truthful, and complete to the best of your knowledge
- You are the creator, rights holder, or duly authorised representative of the content submitted
- You understand that submitting false, misleading, or inaccurate declarations may constitute fraud, misrepresentation, or other actionable conduct under applicable law
- You assume full legal responsibility for the accuracy of all declarations made through your account
- You will not submit content that infringes third-party intellectual property rights, contains unlawful material, or is intended to deceive
TRAXE reserves the right to suspend or permanently terminate accounts found to be submitting false or fraudulent declarations, without notice and without refund.
10 Data Retention & Privacy
TRAXE processes and retains the following categories of data:
- Account data: Email address, subscription plan, and usage history — retained for the duration of the account and for up to 24 months following account deletion
- Registered content: SHA-256 file hash, declared metadata, EXIF signals, and stored file URL — retained indefinitely on the basis of legitimate interest (Article 6(1)(f) GDPR) to support the integrity, immutability, and public auditability of the Verification Record. Files are stored on Supabase cloud infrastructure. Users may request deletion of personal data within a record; however, the cryptographic hash and TRAXE ID will be retained as part of the immutable registry.
- Scan data: AI detection results, individual engine scores, and scan counts — retained indefinitely as part of each Verification Record on the same legitimate interest basis, to support the evidentiary and audit value of the record
- Payment data: Processed and retained by Stripe, Inc. TRAXE does not store payment card details
TRAXE does not sell personal data to third parties. All data processing is conducted in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation). For data access, correction, or deletion requests, contact legal@traxe.co.
11 Intellectual Property
You retain all rights in and to the content you submit to TRAXE. By submitting content, you grant TRAXE a limited, non-exclusive, royalty-free licence to store, process, fingerprint, and display the associated metadata and file hash solely for the purposes of providing the verification service.
TRAXE does not claim ownership of any content submitted to the platform. The TRAXE name, logo, platform architecture, interface design, and software are the sole intellectual property of TRAXE / Your Uncommon Brand VOF and may not be reproduced, adapted, or exploited without prior written consent.
12 Limitation of Liability
To the fullest extent permitted by applicable law, and subject to mandatory consumer protection rights under Dutch and EU law that cannot be excluded:
- TRAXE, its operators, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the platform or reliance on Verification Records
- TRAXE is not liable for any legal proceedings, regulatory investigations, or third-party claims arising in connection with content you have submitted
- TRAXE is not responsible for the misuse, alteration, or misrepresentation of Verification Records by you or any third party
- TRAXE does not warrant that its services are error-free or continuously available, but will use reasonable endeavours to maintain service availability
- Nothing in these Terms limits TRAXE's liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under mandatory Dutch or EU law
- For business users: TRAXE's aggregate liability shall not exceed the total amounts paid by you to TRAXE in the three calendar months immediately preceding the event giving rise to the claim
- For consumer users: statutory rights under Dutch consumer law (Burgerlijk Wetboek) and EU consumer protection directives remain unaffected
13 EU AI Act Compliance Context
TRAXE is designed to support organisational efforts to meet the transparency and disclosure obligations set out in Regulation (EU) 2024/1689 (the EU AI Act). The EU AI Act introduces phased obligations: transparency and disclosure requirements under Article 50 (including AI-generated content labelling) apply from August 2026. Other obligations apply at different dates depending on the risk category of the AI system involved.
TRAXE Verification Records are documentary tools — they are not official regulatory filings, compliance certifications, or legal instruments. Users remain solely responsible for ensuring their own compliance with applicable AI regulations in their jurisdiction. TRAXE strongly recommends that users obtain qualified legal advice regarding their specific compliance obligations.
14 Refund Policy
14.1 — Business Customers (B2B)
If you are subscribing on behalf of a business, agency, studio, or organisation: all subscription fees and scan credit pack purchases are non-refundable once the transaction has been processed. Upon cancellation, access to your plan continues until the end of the current paid billing period. No partial refunds are issued for unused time within a billing period. All purchases are final. Disputed charges must be reported to legal@traxe.co within 14 calendar days of the transaction date.
14.2 — Consumer Customers (B2C)
If you are an EU-based individual purchasing TRAXE for personal use: TRAXE complies with the EU Consumer Rights Directive (Richtlijn 2011/83/EU). You have a statutory 14-day right of withdrawal (herroepingsrecht) from the date of purchase, prior to commencement of the service.
Where you request immediate access to the service upon purchase, your right of withdrawal is waived in accordance with Article 16(m) of the Directive, provided you have given explicit prior consent and acknowledged the loss of the withdrawal right at checkout. This consent is captured via a confirmation checkbox at the point of purchase.
Your statutory rights under Dutch consumer law (Burgerlijk Wetboek, Boek 6) and EU consumer protection legislation remain fully unaffected by these Terms.
14.3 — Auto-Renewal
All TRAXE subscriptions renew automatically at the end of each billing period. TRAXE will continue to charge your payment method on the renewal date until you actively cancel. Cancellation can be performed at any time via your account dashboard and takes effect at the end of the current billing period. No refund is issued for the remaining days of a billing period following cancellation.
15 Governing Law & Jurisdiction
These Terms of Service are governed by and shall be construed exclusively in accordance with the laws of the Netherlands, without regard to its conflict of laws provisions. Any dispute, controversy, or claim arising out of or in connection with these Terms or the use of TRAXE shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands.
16 Amendments
TRAXE reserves the right to amend these Terms of Service at any time. Registered users will be notified of material amendments via email no less than 14 calendar days prior to the effective date of any change. Continued use of the platform following the effective date of an amendment constitutes acceptance of the revised Terms.
